Welcome to Kaya Music Island (“App”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your use of the Kaya Music app and related services. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.

1. Subscription Model

  • Kaya Music operates on a monthly subscription model.
  • By subscribing, you agree to pay the monthly fee displayed within the App.
  • Your subscription will remain active until you cancel it.
  • When you cancel, your access will continue until the end of the billing cycle you have already paid for. No refunds will be provided for partial months.
  • All subscription fees are non-refundable, except where required by law.

2. Payments

  • Payments are processed via MIPS, a Mauritius-based payment system that supports multiple local payment methods.
  • Payment options will be displayed in the App using an in-app browser.
  • Once you select a payment method, MIMPS will handle the transaction securely, and the subscription will be activated upon confirmation of payment.
  • By making a payment, you authorize us to process the transaction through MIMPS.
  • Kaya Music does not store your payment credentials.

3. Cancellation of Subscription

  • You can cancel your subscription at any time through the subscription page within the App.
  • After cancellation, you will retain access until the end of your current billing period.
  • If you re-subscribe, your new billing cycle will start from the date of reactivation.

4. Use of the App

By using Kaya Music, you agree that you will not:

  • Copy, reproduce, or redistribute content without authorization.
  • Use the App for unlawful purposes or in violation of any laws in Mauritius or elsewhere.
  • Attempt to reverse-engineer, hack, or misuse the App.

5. Content and Licensing

  • Kaya Music provides access to licensed music, videos, and other media.
  • All intellectual property rights in the App and its content remain with Kaya or its licensors.
  • You are granted a limited, non-exclusive, non-transferable right to use the App for personal, non-commercial purposes only.

6. Data and Privacy

  • Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
  • By using the App, you consent to the practices outlined in the Privacy Policy.

7. Termination

  • We reserve the right to suspend or terminate your account if you violate these Terms.
  • Upon termination, your right to use the App will immediately cease, without refund.

8. Limitation of Liability

  • We provide the App “as is” without warranties of any kind.
  • We are not responsible for interruptions, errors, or unavailability of the App.
  • Our liability for any claims shall not exceed the amount you paid for the subscription during the last billing cycle.

9. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of Mauritius.
  • Any disputes shall be subject to the exclusive jurisdiction of the courts of Mauritius.

10. Changes to Terms

  • We may update these Terms from time to time.
  • Updates will be posted in the App with a revised effective date.
  • Continued use of the App after updates constitutes your acceptance of the new Terms.
